Subject: Misadminstration definition, Part G.2.I

BACKGROUND

Part G.2.I(6)(b) of the Maine Rules Relating to Radiation Protection is one particular part of the definition of "Misadministration". During the original adoption of this definition (effective January 1, 1994) this portion of the definition was not identified as being incorrect and incompatible with Federal regulations. Since its adoption, as it reads, the Maine regulations have been one tenth of the federally allowable limit for diagnostic misadministrations. This seems to be due to a transcription error, that left out the middle of the sentence, when the proposed regulation was initially typed into the computer.

REGULATORY REQUIREMENTS

Part G.2.I(6)(b) as adopted reads: "When the dose to the patient exceeds 5 rems dose equivalent to any individual organ." The equivalent section of the definition in 10 CFR 35 (35.2) paragraph (6)(ii) under Misadministration reads: "When the dose to the patient exceeds 5 rems effective dose equivalent or 50 rems dose equivalent to any individual organ."

POSITION STATEMENT

To be compatable with the Federal regulations and to enforce this portion of the regulations this Agency will interpret the above referenced section of the Maine rules to read "When the dose to the patient exceeds 5 rems effective dose equivalent or 50 rems dose equivalent to any individual organ."
