Call to Order:
The Meeting was called to order at 9:05 AM.
Approval of June 2, 2009 meeting minutes:
Don Robbins motioned
to accept the June 2009 minutes as amended. Dwight Doughty 2nd the motion. Passed
Open seat on the Commission:
The Commission continues to seek to have
the vacant seat filled by the Governor’s staff.
Update on Complaints:

Corrective action completed, Dean Getchell will inspect.
New Complaints:
John Desjardins vs Woodsome Well Drilling:
Findings
of Fact (motioned by Goodwin):
1) Woodsome Well
Drilling, Inc. failed to respond to the Commission’s written request for
information concerning this complaint dated June 3, 2009.
2) Woodsome Well
Drilling, Inc. installed a Water Ace submersible ¾ H.P. 10 gpm pump set at a
depth of 350 feet, which is significantly beyond the manufacturer’s depth
setting specifications.
3) Woodsome Well
Drilling, Inc. failed to ground the submersible pump motor to the steel casing
as required by the National Electric Code.
4) Woodsome Well Drilling,
Inc. installed the submersible pump using 151 feet of 14 gage wire, and 358
feet of 12 gage wire, which does not meet the design specifications of the
manufacturer for a ¾ H.P. motor.

Given
the above findings of fact, the Commission found the following (motion by
Goodwin):
Violations:
1)
Dan Woodsome and Woodsome Well Drilling, Inc.
violated 144A CMR 232 (The Maine Well Drillers and Pump Installers Rules)
chapter 7, section 700.1 by failing to respond to a written request for
information regarding this complaint by the Commission dated June, 3, 2009. (2nd
Doughty, passed) No violations points
are assigned for this violation (motion Goodwin, 2nd Doughty,
passed).
2)
Dan Woodsome and Woodsome Well Drilling, Inc.
violated 144A CMR 232 (The Maine Well Drillers and Pump Installers Rules)
chapter 6, section 601.1 by installing a submersible pump significantly below
the manufacturer’s specified maximum depth. 2nd Doughty, passed) No violation points are assigned for this
violation (motion Goodwin, 2nd Doughty, passed).
3)
Dan Woodsome and Woodsome Well Drilling, Inc.
violated 144A CMR 232 (The Maine Well Drillers and Pump Installers Rules)
chapter 6, section 600.1 by failing to properly ground the submersible pump
motor to the steel well casing. (2nd
Weddle, passed) 3 violation points were
assigned to Dan Woodsome and Woodsome Well Drilling, Inc. for this violation (motion
Goodwin, 2nd Doughty, passed).
4)
Dan Woodsome and Woodsome Well Drilling, Inc.
violated 144A CMR 232 (The Maine Well Drillers and Pump Installers Rules)
chapter 6, section 600.1 by not following the manufacturer’s specifications
regarding wire sizing. (2nd Weddle, passed) 3 violation points were assigned to Dan Woodsome and Woodsome Well
Drilling, Inc. for this violation (motion Goodwin, 2nd Doughty,
passed).
The
Commission ordered the following corrective action to remedy these violations:

1)
Dan Woodsome, and Woodsome Well Drilling, Inc. must
within 60 days of the date of this notice install a properly sized pump for a
350 foot depth setting and insure all wiring complies with the National
Electric Code and the pump manufacturer’s specifications including the proper
grounding of the pump to the steel well casing. (2nd Weddle, passed)
Written notice that all corrective
action has been completed with 7 days of the completion date.
Total points for driller and company to be reviewed at August meeting.
