Minutes of September 1, 2009 Meeting

Call to Order:
The Meeting was called to order at 9:20 AM.
Approval of July 7, 2009 meeting minutes:
Ike Goodwin motioned to accept the August 2009 minutes as amended. Tom Weddle 2nd the motion. Passed
Open seat on the Commission:
The Commission continues to seek to have the vacant seat filled by the Governor’s staff. MGWA members will (again) be asked to seek help from their legislators. The vacant clerk’s position is also a concern.
Update on Complaints:
Ellen Paoletti - Dunham Well Drilling:
The Commission had determined that the bottom seal in this well is leaking and that the pump was not properly grounded to the well casing at the August meeting. The well drilling was originally suspended at 100 feet due to a large amount of water entering high in the well and the well’s proximity to a lake which resulted in an unreasonable risk of drilling material entering the lake. The driller uses an air rotary drill rig.
After lengthy discussion with the driller and homeowner, it was decided that to insure a proper casing seal the well needs to be drilled deeper, with at least 100 feet of casing set to hold back the near surface water, and a mud rotary drill rig must be used to control water and sediment from entering the lake. An alternative would be a replacement well with similar construction as described above and the original well being properly abandoned. An amendment to the approved Specialty Well Application shall be drafted to allow a replacement well, if needed, to be no closer than 32 feet from the onsite disposal tank. The leach field is over 100 feet away.
The driller agreed to complete this work as soon as possible, and to report back to the Commission by the October meeting that either the work has been completed and the well is properly constructed as ordered previously or a replacement well has been installed, or that a schedule for the work to be completed has been established.

New Business:
David Braley has been assigned oversight of the Department’s Subsurface Wastewater Disposal Program (septic systems). This means that both wells and septic systems will be represented together as a single entity, which should result in much better communication and coordination.
Geo-Thermal:
A public hearing on the proposed geothermal rules for licensure will be held on September 23, 9:00 AM, at the Key Bank Building, 286 Water Street in Augusta.
