There is New Language for Insertion in all State Contract Award Notices?
The Attorney Generals office has recently advised the Division of Purchases that award notification letters to both the successful and the unsuccessful bidders should include notice of the right to appeal the decision. In fact, the AGs office has advised that the 15 day appeal period may not technically begin until the bidder has been advised of these appeal rights. The language they have asked us to use incorporates the mandatory "subject to SPRC approval" language. Here's the paragraph they suggest:
"This award is a final decision, subject to State Purchases Review Committee approval, of the (insert name of department or agency making the award) with regard to the Request for Proposals (identify the RFP by name or service requested). Any person aggrieved by the award decision may appeal the decision to the Director of the Bureau of General Services in the manner prescribed in 5 M.R.S.A. § 1825-E and the rules promulgated thereunder. The appeal must be in writing and filed with the Director of the Bureau of General Services, 9 State House Station, Augusta, Maine 04333-0009 within 15 calendar days of receipt of notification of contract award."
