The named insured requested a hearing to contest the nonrenewal of a homeowners insurance policy due to lack of owner occupancy.  After the hearing, it was determined that the company had issued an unconditional renewal offer subsequent to its issuance of both the nonrenewal notice and its notice to the insured of temporary continuation of coverage pursuant to the Superintendent’s notice of hearing provisional coverage order.
Held: For the insured. The unconditional reinstatement effectively negated the insurer’s prior notice of nonrenewal.
