Robert K. Greene, Keith M. Greene v. Phenix Mutual Fire Insurance Company

The named insured requested a hearing to contest the nonrenewal of homeowners policy for poor condition of property.  The evidence showed that the policyholders were notified in September 2010 of several conditions that needed to be addressed in order for coverage to continue. Some of the conditions remain.

Held: For the company. The Maine Property Cancellation Control Act permits nonrenewal of a homeowners policy for a reason that is in good faith and related to the insurability of the property, and also for failure to comply with reasonable loss control recommendations under section 3049(10). The evidence established that the policyholder understood the company’s action related to the loss control recommendations that had been conveyed, and that one or more of those recommendations had not been completed. The nonrenewal action therefore was allowed under 24-A M.R.S.A. § 3049(10) as well as section 3051.
