Leo & Cheryl McGuire v. Patrons Oxford Insurance Company

Held December 4, 2012 – Docket No. INS-12-2130
Decision Issued:  December 21, 2012

The named insured requested a hearing to contest the nonrenewal of a homeowners policy for cited conditions of the property.  The company demonstrated that the improper installation of the woodstoves and a metalbestos chimney, the construction of the roof of the addition, and the lack of an automatic central heat source all increase the risk of loss covered by the policy.

Held: For the company. 24-A M.R.S. § 3051 permits nonrenewal based upon a reason that is in good faith and related to the insurability of the property. Patrons identified and documented several conditions that increase the risk of loss, therefore the nonrenewal action is permitted.
