The named insured requested a hearing to contest the nonrenewal of an automobile policy for cited moving violations.  At hearing it was determined that the policy insures more than four vehicles; therefore the Maine Automobile Insurance Cancellation Control Act is not applicable.

Held: Dismissed. In order to hold a hearing regarding the nonrenewal of an automobile policy, the policy must be subject to the Cancellation Control Act, 24-A M.R.S. §§ 2911-2924. As the Act does not apply to a policy insuring more than four vehicles, which was not known until the policy was submitted as evidence, the appropriate governing statute is 24-A M.R.S. § 2908. As this section does not provide the right to a hearing for a nonrenewal action, the proceeding was dismissed due to lack of subject matter jurisdiction over the intended action.
