  NOW COME the parties who have appeared in this action and stipulate that judgment in this case shall enter for Plaintiff State of Maine and against Defendants Bobby J. Miller and Giroux Developing, Inc., and that Plaintiff State of Maine’s claims against Defendant Heather Miller shall be dismissed.

  Defendants Bobby J. Miller and Giroux Developing, Inc. agree to judgment containing the following relief:

  1.  Defendants Bobby J. Miller and Giroux Developing, Inc. are permanently enjoined from selling any business opportunity, as defined by 32 M.R.S.A. § 4691(3) (1999), in the State of Maine.

  2.  Defendants Bobby J. Miller and Giroux Developing, Inc., jointly and severally, shall pay Plaintiff State of Maine $10,000.00 in restitution to be distributed to Thomas and Terry Sullivan.  The restitution shall be paid in four installments of $2,500.00 each.  The first installment shall be paid no later than January 6, 2006, and the remaining installments shall be paid no later than February 3, 2006,  March 3, 2006, and April 7, 2006, respectively.  Should Bobby J. Miller and Giroux Developing, Inc. fail to make any of these payments by the dates indicated, all of the remaining restitution shall become immediately payable.

  Plaintiff’s claims against Defendant Heather Miller are dismissed.  Judgment entered for Plaintiff against Defendants Bobby J. Miller and Giroux Developing, Inc. in accordance with the terms of this Consent Judgment.   This Court retains jurisdiction over this matter.  This Order shall be incorporated into the docket by reference.
