Notices are published each Wednesday to alert the public regarding state agency rule-making. You may obtain a copy of any rule by notifying the agency contact person. You may also comment on the rule, and/or attend the public hearing. If no hearing is scheduled, you may request one -- the agency may then schedule a hearing, and must do so if 5 or more persons request it. If you are disabled or need special services to attend a hearing, please notify the agency contact person at least 7 days prior to it. Petitions: you can petition an agency to adopt, amend, or repeal any rule; the agency must provide you with petition forms, and must respond to your petition within 60 days. The agency must enter rule-making if the petition is signed by 150 or more registered voters, and may begin rule-making if there are fewer. CHAPTER NUMBER AND TITLE: Ch. 11, Rules Governing the Controlled Substances Prescription Monitoring Program: Section 5, Requirements for Dispensers
PROPOSED RULE NUMBER: 2014-P218
BRIEF SUMMARY: This amendment to rule 14-118 CMR ch. 11, Rules Governing the Controlled Substances Prescription Monitoring Program, Section 5, Paragraph 2, Part D, Requirements for Dispensers shortens the time within which dispensers must report from within seven (7) days of the controlled substance being dispensed to within twenty-four (24) hours of the controlled substance being dispensed.
Primary sources in the determination to decrease the reporting timeframe were (i) the September 2012 Brandeis University Center of Excellence white paper on prescription drug monitoring program best practices, reports increased demands from all healthcare providers (especially emergency department prescribers, for more immediate online reports in providing appropriate treatment and detect any prescription drug misuse and/or diversion ; (ii) the August 21, 2012 recommendations of the PMP subgroup of the Maine Prescription Drug Task Force, established by Executive Order 2012-002, (iii) a Spring 2013 Hornby Zeller Associates/DHHS SAMHS survey of PMP enrollees, indicating that the biggest challenge to using the PMP was lack of real time data, and (iv) PMP Advisory Committee discussion on August 20, 2012 agreeing on the need for more timely controlled substance uploads from dispensers.
DETAILED BASIS STATEMENT / SUMMARY:
Rationale: Reducing dispenser reporting timeframe the Amendment will support more informed prescribing for all healthcare providers and will assist to improve detection of activity that may signal drug diversion and misuse.
The value of real-time data (or as close to real-time as possible) is well-established. (Source: Briefing on PDMP Effectiveness: “Prescription Drug Monitoring Programs: An Assessment of the Evidence for Best Practices”.) As noted there, “This means that even PDMPs that supply end users with immediately available online reports are delivering data that often do not include patients’ most recent prescription purchases. These omissions compromise the utility of prescription history data for clinical practice and drug diversion investigations (PDMP COE, NFF 2.3). . . . PDMPs across the country report increased demands from prescribers, particularly emergency department physicians, for prescription histories of their patients that are complete at the time of seeing a patient.”
Feedback from prescribers and pharmacists alike from a survey SAMHS conducted in 2013 indicated the greatest challenge in using PMP is the lack of real-time data. “Pharmacists and prescribers in particular see this as a challenge to using the system to its greatest effect in prescribing and dispensing appropriate medications and in detecting misuse and diversion.” (Source: “2013 Prescription Monitoring Program Survey Results”, Hornby Zeller Associates, Inc. Many states are considering moving towards real-time or daily uploads as recommended by various agencies and organizations. States vary in data collection intervals. Currently there are 14 states which require daily uploads and 2 states requiring uploads every 3 days. Oklahoma is now collecting real time data and has found that patient queries increased, and at the same time saw a sharp drop in doctor shopping. Barriers to adoption: There will be an annual enhancement cost (as quoted in 2014 by Health Information Designs, the PMP vendor,) of approximately $7,800 for the 24-hour reporting feature. This cost will not be passed on to pharmacies. Depending on the database used by pharmacies for uploading data, there may be a minimum cost associated with some minor upgrades to the pharmacy uploader database system.
Notice: To allow all pharmacies to adjust to the new reporting timeframe, SAMHS will inform dispensers / uploaders and providers regarding this change through the PMP list serve. Notice will be posted on the PMP website and The Maine Board of Pharmacy along with other Maine licensing boards will be notified of this rule change. Various associations such as Maine Medical Association and Maine Pharmacy Association will be notified. Governor’s Substance Abuse Service Commission (SASC) and PMP Advisory Committee will also be notified.

BRIEF SUMMARY: The Department is proposing a new rule specifically addressing stormwater compensation fees and mitigation credits. The Ch. 501, Stormwater Management Compensation Fees and Mitigation Credit rule, will establish a program allowing applicants to undertake a compensation project, or pay a compensation fee in lieu of meeting certain stormwater control requirements. While these provisions were formerly included in Ch. 500 of the Department’s rules, the Department is now proposing to update and establish these requirements as a separate rule.

CONCISE SUMMARY: A new MaineCare waiver program will provide an alternative to institutional care for adults with brain injuries. This rule sets forth the eligiblitity criteria for this waiver program. The Centers for Medicare and Medicaid Services approved this waiver with an effective date of July 1, 2014.
The proposed rule also removes the Home and Community Benefits for the Physically Disabled Waiver eligibility group and changes the budgeting process and eligibility calcualtions to subtract 200% of the FPL as a Personal Needs Allowance (PNA) for all single-person households within the Home and Community Benefits (HCB) Waiver Program for the Elderly and for Adults with Disabilities. This is equal to the PNA for all other Home and Community-Based Waiver programs.

CHAPTER NUMBER AND TITLE: Ch. 7, Requirements for Municipalities Having Shellfish Conservation Programs

CONCISE SUMMARY: This rule-making implements measures to update the regulations for towns with approved Shellfish Conservation Programs by adding definitions, clarifying management responsibilities, clarifying the revocation of approved ordinance procedures; clarifying the license allocation process, specifying conservation closure and opening permit requirements and defining conservation activities and procedures.
In response to public comments, three minor changes were made to the proposed rule. The word “shall” has been replaced with the word “may” in Section 7.30, “Municipal Responsibilities”. The adopted sentence would now read: “Municipalities with an approved Shellfish Management Plan may be required to conduct resource surveys on a periodic basis of the commercially productive areas within the municipality classified as approved or conditionally approved, using Department-approved methods.” Also, in Section 7.50(1)(B), “Municipal Shellfish Conservation Activities”, the municipal shellfish conservation closure/opening application request requirement has been lowered from 30 days as proposed to 20 business days. Finally, in Section 7.50(2)(A) the following sentence was added to better clarify the requirement for possession of undersized shellfish: “Municipalities must apply at least 10 business days prior to the requested date in writing on Department approved forms to the Department for a Shellfish Transplant Permit.”
As authorized by 12 M.R.S §§ 6671, 6673, 6681, the Commissioner of Marine Resources adopts this regulation.

CHAPTER NUMBER AND TITLE: Ch. 11, Scallops: Atlantic Sea Scallop Regulations and 2014-2015 Harvesting Season
ADOPTED RULE NUMBER: 2014-248
CONCISE SUMMARY: This rule-making establishes the 2014-2015 scallop fishing season. This season is undertaken with the understanding that the length of the season as presented likely far exceeds what the resource can sustain, and that the Department may need to use emergency rule-making authority during the season to prevent overfishing. The industry, through the Scallop Advisory Council, has requested that the Department provide the fishing opportunity up front, and make adjustments in season as necessary. The Department is willing to take this approach in part because this fishery is prosecuted in the winter months, and proposing a very limited season could create an incentive to fish in unsafe conditions. The Department will take action to continue to rebuild the scallop resource, as well as provide stability and predictability for the industry into the future. After the fishery experienced an all-time low in 2005 of 33,000 lbs. of landings, Maine fishermen and the DMR began to implement a series of forward thinking management measures aimed at rebuilding the depleted scallop resource while also providing some economic opportunity in a limited fishery.
The 2014-15 season follows the pattern of the 2013-14 season with a daily possession limit for Zone 1 & 2 of 15 gallons with a 70-day season, while Zone 3 would have a 10-gallon daily limit with a 50-day season. For Zone 1 & 2, a 70-day season is set for draggers to start on December 1, 2014 with fishing prohibited on Fridays, Saturdays and Sundays in December, January, February and April. December 26, 2013 and January 2, 2015 are open and December 24, 25 and 31, 2014 and January 1, 2015 would be closed. Scallop fishing by Zone 1 & 2 draggers in the month of March would be prohibited on Thursdays, Fridays, Saturdays and Sundays. The last day of the Zone 1 & 2 drag season is April 9, 2015. For Zone 1 & 2, a 70-day season is set for divers to start on December 3, 2014 with fishing prohibited on Sundays, Mondays and Tuesdays in December and April with the exception of December 22, 23, 29, and 30 which would be open. December 24, 25 and 31, 2014 would be closed. Scallop fishing by Zone 1 & 2 divers in the months of January and February would be prohibited on Sundays, Mondays, Tuesdays and Saturdays plus January 1, 2015 would be closed. In March 2015, fishing is prohibited on Sundays and Mondays. Fishing is also prohibited on Tuesday, March 3, 2015. The last day of the Zone 1 & 2 dive season is April 11, 2015. For Zone 3, a 50-day season is set for draggers to start on December 1, with fishing prohibited on Thursdays, Fridays, Saturdays and Sundays. December 24, 25, and 31, 2014 and January 1, 12, 13, 14, 19, 20 and 21, 2015 would be closed and December 26, 2014 and January 2, 2015 would be open. The last day of the Zone 3 drag season is April 7, 2015. For Zone 3, a 50-day season is set for divers to start on December 4, 2014 with fishing prohibited on Sundays, Mondays, Tuesdays and Wednesdays in December, March and April. December 23 and 30, 2014 would be open and December 24, 25 and 31, 2014 would be closed. Scallop fishing by Zone 3 divers in the months of January and February would be prohibited on Saturdays, Sundays, Mondays and Tuesdays plus January 1, 14, 15, 16, 21, 22 and 23, 2015 would be closed. The last day of the Zone 3 dive season is April 11, 2015.
Based upon comments received during the proposed rule-making process, the Department has changed the following items in the adoption documents:
* Saturdays have been removed from the Zone 1 & 2 Dive Calendar and moved to Wednesdays for the months of January and February at the request of industry. This follows the pattern of past fishing seasons with no Saturdays in January and February. It also better aligns access with the Zone 3 Dive Calendar. One of the Saturdays in January was redistributed to a Tuesday in March.
* Two days in April (14 and 15) were moved up into March to better condense the Dive calendars due to concerns that scallops are starting to spawn at that time of year. This effectively moved the end date of the fishery up from April 15 to April 11. These days were redistributed to Tuesdays in March.
* A correction was made to access for the Muscle Ridge Area to clarify that access be Mondays and Tuesdays for draggers and Wednesdays and Thursdays for divers. This will better compliment access to local Limited Access Area, as requested by industry.
* Finally, a clarification was made to the Zone 1 & 2 Drag Calendar stating that in March 2015 fishing is prohibited on Sundays so as to accurately reflect the 70-day season calendar.
In addition, the DMR is implementing a number of targeted closures based on depletion and the presence of spat-producing scallops which include Eastern Casco Bay, Damariscotta River, Ocean Point, Muscle Ridge (open two days per week) and Lower Muscle Ridge as well as to protect municipal mooring fields in Blue Hill Harbor, Western Blue Hill Bay, Bartlett’s Harbor, Seal Harbor, Northeast Harbor and Somes Sound. Also, the DMR has adopted language to clarify daily possession limits. Finally, the trigger mechanism will be extended to the entire state scallop fishery, whereby if the DMR receives information indicating that a likelihood of 30-40% of the harvestable biomass has been removed, the Commissioner will close harvesting for the remainder of the season through emergency action.
As authorized by 12 M.R.S §6171, the Commissioner of Marine Resources adopts this regulation.

CONCISE SUMMARY: This rule-making removes regulations that DMR does not implement such as the Performance Based Inspection Program and remove unnecessary language including the shellfish bacteriological standards and shellfish contamination standards for import. The rule-making also incorporates the most recent updates to the 2013 National Shellfish Sanitation Program Guide and makes editorial clarifications throughout including to the wet storage, comingling and definitions sections. The changes also allow for the retail sale of shellstock from an aquaculture lease or LPA site consistent with recent statute changes and allow dealer to dealer bulk tagging of product.
As authorized by 12 M.R.S §6856, the Commissioner of Marine Resources adopts this regulation.

CONCISE SUMMARY: The principal reason for this rule-making is to increase the spiny dogfish commercial daily trip limit from 4,000 to 5,000 pounds effective September 8, 2014. This will expand commercial fishing opportunity, by amending the commercial trip limit regulation to comply with the Atlantic States Marine Fisheries Commission (ASMFC) fishery management plan. On August 6, 2014, the ASMFC’s Spiny Dogfish & Coastal Shark Management Board increased the daily trip limit to 5,000 pounds effective September 8, 2014.

CONCISE SUMMARY: Black sea bass (Centropristis striata) have become increasingly present in the Gulf of Maine and Maine state waters in recent years. This rule-making implements measures consistent with the Atlantic States Marine Fisheries Commission (ASMFC) Interstate Fishery Management Plan regarding reporting, possession, and conservation measures for black sea bass in order to provide expanded access for recreational fishermen, and additional economic opportunity for commercial harvesters on this valuable stock. The State of Maine’s current quota for black sea bass is .5% of the annual Total Allowable Catch for commercial harvest (10,850 lbs. in 2014). Recreational measures provide parity with those in place in neighboring states’ waters.
